THE INSTITUTION OF BLOOD FEUD ACCORDING TO LEKË DUKAGJINI CODE AND THE ISSUE OF ERADICATING BLOOD FEUD

Abstract

The Lekë Dukagjini Code (LDC) is the most systematized form of Albanian customary law. The twelve chapters (“Books”) of the Code with a total of 1263 paragraphs express the social organization by the tribe, in the absence of the state as a territorial unit with an institutional governmental organization. The institution of blood feud takes shape through the definition of this phenomenon and the regulation of its conditions and procedures, mainly in the tenth chapter entitled “Libri Kundra Mbrapshitëvet” (Book against bad deeds). This article intends to illuminate the fact that the institution of blood feud according to the LDC prohibits murder and aims the eradication of blood feud, in order to give an adequate direction towards the eradication of the deformed blood feud in the presence of the state and the Criminal Code.
